Agreement to Terms

By accessing or using RouteFuel™ ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use our service.

These Terms apply to all visitors, users, and others who access or use RouteFuel.

Eligibility

You must be at least 13 years of age to use RouteFuel. By using our service, you represent and warrant that:

You are at least 13 years old
If you are under 18, you have obtained parental or guardian consent
You have the legal capacity to enter into these Terms
Your use of RouteFuel does not violate any applicable law or regulation

Description of Service

RouteFuel is a web application that integrates with Strava and Spotify to allow athletes to:

Visualize Strava activities on interactive maps
Create and manage Music Pins™ to attach Spotify tracks to GPS locations on routes
Receive AI-powered music recommendations based on activity data
Simulate activity playback with synchronized music
Create Spotify soundtracks from Music Pins™

RouteFuel is currently provided free of charge. We reserve the right to introduce paid features in the future with appropriate notice.

Account Responsibilities

When you create an account with us, you agree to:

Provide accurate, current, and complete information
Maintain the security of your password and account
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use
Not share your account credentials with others

We reserve the right to suspend or terminate accounts that violate these Terms.

Third-Party Integrations

RouteFuel integrates with third-party services. By using these integrations, you acknowledge:

Strava

You must have a valid Strava account and comply with Strava's Terms of Service
RouteFuel accesses your activity data through Strava's API with your authorization
You may revoke access at any time through your Strava settings

Spotify

You must have a valid Spotify account and comply with Spotify's Terms of Use
RouteFuel accesses your soundtracks and playback controls through Spotify's API with your authorization
Music playback is subject to Spotify's licensing and availability
You may revoke access at any time through your Spotify settings

We are not responsible for the availability, terms, or policies of third-party services.

Intellectual Property

Our Intellectual Property

RouteFuel™ and Music Pins™ are trademarks of RouteFuel
Our technology is protected by a pending U.S. patent application
The RouteFuel service, including its design, features, and code, is our proprietary property
You may not copy, modify, distribute, or reverse engineer any part of our service

Your Content

You retain ownership of your original athletic activity data and audio data (e.g. music and soundtracks) - in accordance with Strava and Spotify subsription and usage terms. By using RouteFuel, you grant us a non-exclusive, worldwide license to:

Create Music Pins™, custom soundtracks, and other content you create
Store, display, and process your Music Pins™ to provide our service
Share public Music Pins™ with other RouteFuel users as part of the service's functionality
Publish your RouteFuel enhanced and featured soundtracks to our Community users

This license ends when you delete your content or account, except for content shared publicly or with other users.

Prohibited Uses

You agree not to:

Use RouteFuel for any unlawful purpose
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with or disrupt the service or servers
Scrape, harvest, or collect data from RouteFuel without permission
Upload malicious code, viruses, or harmful content
Impersonate another person or entity
Use automated systems (bots, crawlers) without our written consent
Circumvent any security or access controls
Violate the intellectual property rights of others

Service Modifications

We reserve the right to:

Modify, suspend, or discontinue any part of RouteFuel at any time
Add or remove features without prior notice
Perform maintenance that may temporarily interrupt service
Update these Terms with reasonable notice

We will make reasonable efforts to notify users of significant changes, but are not liable for any modification, suspension, or discontinuation of the service.

Disclaimer of Warranties

RouteFuel is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Accuracy, reliability, or completeness of content
Uninterrupted or error-free operation
Security or freedom from viruses or harmful components

We do not warrant that Strava or Spotify integrations will always be available or function without interruption.

Limitation of Liability

To the maximum extent permitted by law, RouteFuel and its owners, operators, and affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Any damages arising from your use or inability to use the service
Any conduct or content of third parties on the service
Unauthorized access to or alteration of your data

In no event shall our total liability exceed one hundred dollars ($100 USD).

Indemnification

You agree to indemnify, defend, and hold harmless RouteFuel and its owners from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

Your use of the service
Your violation of these Terms
Your violation of any third-party rights
Content you submit or share through RouteFuel

Termination

We may terminate or suspend your account and access to RouteFuel immediately, without prior notice, for any reason, including:

Violation of these Terms
Conduct that we determine is harmful to other users or RouteFuel
Extended periods of inactivity

Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, indemnification, and limitations of liability.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.

Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

We will update the "Last updated" date at the top of this page
For material changes, we will provide notice through the service or by email
Your continued use of RouteFuel after changes constitutes acceptance of the new Terms
